Terms of Service

These Terms of Service ("Terms") govern your use of printforge.ink and any order you place with Kilich Designs Inc., doing business as PrintForge Ink ("we," "us," "our"). By placing an order, you agree to these Terms.

1. Agreement to These Terms

By using this website, uploading artwork, or placing an order, you confirm that you are at least 18 years old and legally able to enter into a contract, and that you accept these Terms in full. If you are ordering on behalf of a company, you confirm you have authority to bind that company.

If you do not agree to these Terms, do not place an order.

2. What We Provide

PrintForge Ink produces custom-decorated apparel and transfer products, including DTF (direct-to-film) transfers, gang sheets, screen printing, and DTG printing. We print artwork that you supply. We are a production service, not a design service, unless design work is separately agreed and quoted.

3. Ordering and Payment

• Prices are shown in U.S. dollars and are subject to change without notice. The price we confirm with you is the price that applies to your order.
• Payment is due in full before production begins. We confirm your order and arrange payment by phone or in person.
• Quoted prices are estimates until confirmed. Final pricing depends on quantity, garment, print size, print locations, ink colors, and artwork.
• Applicable sales tax will be added where required. If you are tax-exempt, provide valid documentation before ordering.
• We reserve the right to refuse or cancel any order for any lawful reason, including suspected fraud, pricing errors, or content that violates Section 5. If we cancel before printing, you receive a full refund.

4. Your Artwork and Intellectual Property

By uploading artwork or submitting an order, you represent and warrant that:

• You own the artwork, or you have written permission from the rights holder to reproduce it commercially;
• The artwork does not infringe any copyright, trademark, trade dress, right of publicity, or other right of any third party;
• You have the right to use any name, likeness, logo, team mark, brand, or character appearing in the artwork;
• Reproducing the artwork does not violate any law or contract.

You grant us a limited, non-exclusive license to reproduce, modify (for technical print preparation only, such as resizing or color conversion), and print your artwork solely to fulfill your order.

We will not display your artwork publicly, in our portfolio, or on social media without your permission.

If a third party asserts that your artwork infringes their rights, we may suspend or cancel the order and are not liable to you for doing so.

5. Content We Won't Print

We reserve the absolute right to refuse any job. We will not knowingly print artwork that:

• Infringes intellectual property you don't have rights to
• Depicts or sexualizes minors
• Promotes hatred or violence against people based on race, ethnicity, religion, national origin, gender, sexual orientation, disability, or other protected characteristic
• Threatens or harasses a specific person
• Uses a real person's name or likeness without permission
• Is fraudulent, such as counterfeit brand goods or fake credentials
• Violates any applicable law

If we decline an order under this section before printing, we will refund you in full. If we discover the issue after printing has begun, Section 7 applies.

6. Artwork Quality and Color

Resolution

For best results, supply artwork at 300 DPI at the final printed size, as a PNG with a transparent background, in RGB color. We will flag artwork that falls below 150 DPI before printing where possible.

Color

Screens emit light; ink sits on fabric. Colors will not match your monitor exactly. Monitor calibration, fabric color, fabric type, and material all affect the final appearance. We print from your RGB file and our RIP software handles color conversion. We do not guarantee exact color matching, including Pantone matching, unless specifically agreed in writing in advance.

Layout and mirroring

Do not mirror or reverse your artwork — our RIP software handles that automatically. Pre-mirrored files will press backwards, and that result is not a defect.

Your layout is what we print

For gang sheets and transfer orders, we print exactly the layout you supply. We do not proofread, spell-check, resize, or rearrange your layout. Verify spelling, sizing, spacing, and placement before you pay.

7. Final Sale Policy

This includes, without limitation:

• Errors in your artwork — spelling, sizing, color choice, or layout
• Low-resolution files producing blurry output
• Ordering the wrong quantity, dimensions, or product
• Change of mind, or no longer needing the order
• Color appearing different from your screen
• Delays in production or shipping

Cancellation before printing: If you contact us before production begins, we will make a reasonable effort to cancel and refund. Once your file has entered production, cancellation is not possible.

Manufacturing defects

The above does not apply to genuine manufacturing defects on our end — for example, transfers that will not adhere when pressed per our instructions, misprints caused by our equipment, or the wrong file being printed due to our error.

Report a suspected defect within 7 days of receiving your order, with photographs, to sales@printforge.ink. If we confirm a defect we caused, we will reprint the affected items at no charge. Reprint is the sole remedy. Nothing in these Terms limits any right you have under applicable consumer protection law that cannot lawfully be waived.

8. Production Times

Any turnaround time we quote is an estimate, not a guarantee. Production begins after payment clears and after any artwork questions are resolved — delays in responding to us will delay your order.

We are not liable for missed deadlines, events, or consequential losses arising from production or delivery delays. If you have a hard deadline, tell us before ordering so we can confirm feasibility.

9. Shipping

• Shipping costs and estimated transit times are calculated at checkout or quoted separately.
• You are responsible for providing a complete and accurate shipping address. Packages lost or delayed because of an incorrect address are not our responsibility, and reshipment will be at your cost.
• Once we hand a package to the carrier, title and risk of loss pass to you.
• Carrier delays, weather disruptions, misrouting, and damage in transit are outside our control. Claims for carrier damage or loss must be pursued with the carrier, though we will provide documentation to support your claim.
• We currently ship within the United States. International shipping may be available by arrangement; any duties, taxes, or customs fees are your responsibility.

10. Pickup and Local Delivery

Pickup is available at 253 57th Street, Brooklyn, NY 11220 during business hours. We will notify you when your order is ready.

Please collect your order promptly once notified. If an order goes uncollected for an extended period, we will attempt to reach you at the contact details you provided to arrange pickup, delivery, or shipping at your cost.

Local delivery within the New York City area may be available; terms and fees are arranged per order.

11. Warranty Disclaimer

We make no warranty regarding how long a transfer will last on a given garment, since that depends on your pressing equipment, technique, fabric, and care practices. Follow our pressing instructions for best results.

12. Limitation of Liability

Specifically, if a transfer is defective, our liability is limited to reprinting the transfer. We are not responsible for the cost of garments or other blanks you ruined while pressing. Always test one piece first.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Kilich Designs Inc., PrintForge Ink, and its owners and employees from any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising from:

• Artwork you supplied, including any claim of intellectual property infringement or violation of a right of publicity
• Your breach of these Terms
• Your violation of any law or third-party right

This obligation survives completion of your order.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute shall be brought exclusively in the state or federal courts located in Kings County, New York, and you consent to the jurisdiction of those courts.

Before filing any claim, you agree to contact us first and attempt to resolve the matter informally for at least 30 days.

15. Changes to These Terms

We may revise these Terms at any time. The "Last updated" date reflects the current version. The Terms in effect at the time you place an order are the ones that govern that order.

16. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your order.
